SAMPLE STALLION SERVICE CONTRACT
This agreement is by and between The Old Place, hereinafter
referred to as Stallion Owner and/or Manager and
___________________________________, hereinafter referred to as Mare
Owner. Stallion Owner hereby agrees to breed the Paint Horse
Stallion, _____________ to the
mare,__________________________________________________________ BREED
______________ REGISTRATION NO. _______________________________ SIRE
_________________________________ DAM, ____________________________
which is owned or leased by Mare Owner during the breeding season of
_________.
Mare Owner hereby agrees to pay the following fees for service
pursuant to this agreement.
1. A non refundable boarding fee of $_____.00/dry and $___.00/wet
will shall be charged to Mare Owner by Stallion Manager for each
day afore stated mare (and foal) are at The Old Place. Said
boarding fee shall be paid before afore stated mare (and foal)
leave The Old Place.
2. Non refundable veterinary and farrier fees shall be charged
to Mare Owner by Stallion Manager for appropriate services for
afore stated mare (and foal). Said fees shall be paid aforesaid
mare and (foal) leave The Old Place.
3. A stud fee of $__________.00 shall be charged. A $______.00
non refundable booking fee is due upon the signing of this
contract. The balance of the stud fee is due and payable when the
afore stated mare is picked up from The Old Place. Should the
afore stated mare fail to deliver a live (paint colored) foal, the
mare will be re bred without charge of additional stud fees.
Mare Owner hereby agrees that Stallion Owner reserves the right
to refuse service to any mare which appears to be diseased or which
is unfit for breeding, in the opinion of the Stallion Owner.
It is agreed by the parties hereto that if the afore stated
stallion should die, be sold or become unfit for breeding before
serving afore stated mare, or if afore stated mare should die, be
sold or become unfit for breeding before served, this agreement is
and shall be null and void, except for provisions in paragraphs 1 and
2.
Mare Owner hereby agrees to hold Stallion Owner harmless from any
claim resulting from accidental injury or death of afore stated mare
(and foal).
Should afore stated mare (and foal) become missing, lost,
estrayed, seriously injured, sick or dead, Stallion Owner hereby
agrees to notify Mare Owner or his authorized agent immediately by
telephone.
Stallion Owner hereby agrees to hold Mare Owner harmless from any
claim resulting from damage or injury by afore stated mare (and
foal).
Stallion Owner hereby agrees to maintain afore stated mare (and
foal) in good condition pursuant to this agreement, with proper care,
handling and protection, according to the rules of good animal
husbandry and reasonable standards and practices of the horse
industry.
Stallion Owner hereby agrees that Mare Owner may go upon Stallion
Owner's premises at any time and inspect afore stated mare (and foal)
and determine if same is in good health and being properly care for.
IF ARRANGEMENTS ARE NOT MADE TO PICK UP MARE (AND FOAL) AND ALL
INCURRED EXPENSES PAID BY ______________, THE AFORE STATED MARE (AND
FOAL) WILL BE CONSIDERED ABANDONED AND WILL BE DISPOSED OF AT PUBLIC
AUCTION.
This agreement and all covenants and agreements herein contained
shall accrue to and be binding upon the parties hereto, their heirs,
successors, administrators, and executors. Upon material breach of
this agreement by one party, the other party may terminate same.
No modification of this agreement shall be binding unless in
writing and executed by the parties hereto.
This agreement is subject to the laws of the state of Arkansas,
executed on ________________.
